§401.   Definitions.
§402.   Smoking of tobacco prohibited in government offices; signs.

     §401.  Definitions.
     As used in this chapter, unless the context otherwise requires, the term:

     (a)  "Except in designated areas" means those areas which may be designated as smoking areas by the:

     (1)  Speaker for the Legislative Branch;

     (2)  Chief Justice of the State Court of Yap for the Judiciary Branch;

     (3)  Chairman of the Council of Pilung and the Chairman of the Council of Tamol for the traditional councils; and

     (4)  Governor for the Executive Branch and other government agencies.

     (b)  "Government" means the Government of the State of Yap including all its agencies.

     (c)  "Offices" means government offices including buildings whether owned or rented but does not include homes that might be leased or owned by the government, or  government facilities leased to private entities or persons.

     (d)  "Tobacco Products" means and includes cigarettes, cigars and pipes.

     §402.  Smoking of tobacco prohibited in government offices; signs.

     (a)  Except in designated areas, smoking of any tobacco product shall be prohibited in all government offices, and in all offices which are being rented or leased by the government.  Where only a part of a building is rented or leased by the government, this prohibition shall only apply to the part of the building that is rented or leased by the government for use as an office.

     (b)  Within every office in which smoking is prohibited under subsection (a) of this section, signs shall be posted in sufficient number and in such locations as to be readily seen by persons within such areas, which shall clearly designate that the smoking of any tobacco product is prohibited.
