Exhibition of Adult Films

§ 9001.  Purpose.

     § 9001.  Purpose.
     The purpose of this Chapter is to protect the residents of Chuuk State Truk District from unwilling exposure to possibly offensive sexual materials contained in motion pictures commercially exhibited and to protect children from such materials.

     § 9002.  Adult films.

     (1)  An adult film as defined by this Chapter is a motion picture containing material distinguished or characterized by an emphasis on matter depicting, describing or relating to specified sexual activities or specified anatomical areas.

     (a)  For the purpose of this Section, specified sexual activities is defined as:

     (i)  Human genitals in a state of sexual stimulation or arousal;

     (ii)  Acts of human masturbation, sexual intercourse or sodomy;

     (iii)  Fondling or other erotic touching of human genitals, pubic region, buttock or female breast.

     (b)  For the purpose of this Section, specified anatomical areas is defined as:

     (i)  Less than completely and opaquely covered human genitals, pubic region and female buttock;

     (ii)  Human male genitals in a discernibly, turgid state, even if completely and opaquely covered.

     § 9003.  Exhibition posting.
     No motion picture exhibitor shall commercially exhibit adult films without posting signs in English and Chuukese Trukese at all entrances to the theater or place of exhibition which shall state the film exhibited is an adult film and that no persons under 18 eighteen years of age shall be allowed admission.

     § 9004.  Criminal penalty.
     Any motion picture exhibitor who violates Section 9003 of this Chapter or who willfully and knowingly allows persons under 18 eighteen years of age admission to a commercial exhibition of an adult film shall be guilty of unlawfully exhibiting adult films and upon conviction thereof shall be imprisoned for a period of not more than six months or fined not more than 100 one hundred dollars, or both.
