§1001.   Public Transportation System.

     §1001.  Public Transportation System.
     There is hereby created a Public Transportation System which shall be under the supervision of the Board of Directors of the Public Transportation System.

§1002.  Board of Directors.
     There is hereby established a Board of Directors of the Public Transportation System which shall consist of five members.  All five members shall be appointed by the Governor subject to the advice and consent of the Legislature. Members shall hold membership on the Board for a period of two years, subject to reappointment, and until their successors have been appointed and confirmed.  All vacancies occurring in the offices of Directors shall be filled for the unexpired term in the same manner as the original appointment of the Director whose vacancy is being filled, except that an unexpired term of less than one year shall be filled by appointment by the Governor.  The Board's majority decision shall in all cases be final and controlling.

     §1003.  Organization and meetings.
     The Board shall by majority vote elect from among its members a Chairman who shall serve for such term as may be prescribed by the Board.  In the event of absence or disability of the Chairman, the Board may designate another member to preside during the meeting.  Three members of the Board shall constitute a quorum.  The Board shall meet at such times and places as it may designate but not less than twice a year.

     §1004.  Duties and functions of the Board.
     The duties and functions of the Board shall be as follows:
 
     (a)  To establish reasonable fares and determine suitable routes to be serviced by the Public Transportation System;

     (b)  To ensure that the Public Transportation System is operated efficiently on a self-supporting basis;

     (c)  To contract the management of the Public Transportation System to either the government sector or the private sector;

     (d)  To determine other feasible routes and stops for the purpose of expanding the Public Transportation System as much as the management recommends to be practical;

     (e)  To provide transportation to and from school for the schoolchildren of Yap State who do not have and cannot afford other means of transportation; and

     (f)  Such other purposes as may be determined by the Board to be beneficial to the people of Yap State and within the financial capabilities of the Public Transportation System.

     §1005.  Revenue of the Public Transportation System.
     Revenues generated by the Public Transportation System shall be deposited in an account or accounts to be used solely for the operation, maintenance or expansion of the Public Transportation System.  The Board and the contractor of the Public Transportation System shall enter into a written agreement which governs the accounting and disposition of all gross revenues.

     §1006.  Rules and regulations.
     The Board, in consultation with the contractor of the Public Transportation System, is hereby authorized to issue and promulgate rules and regulations implementing the provisions of this chapter, which rules and regulations shall have the force and effect of law.

     §1007.  Compensation.
     Any member of the Board who is an employee of the State Government shall be granted administrative leave with pay while attending meetings of the Board. Non-State Government members of the Board shall receive compensation of $25.00 per meeting.
